    Moving
    So I know I've said a bunch of times, "Fuck Buffalo, I am moving." and then not gone any place.

    I signed the lease on my new apartment in Tulsa, OK today.

    I'm moving at the end of October to come to Tulsa for school.

    So...yeah. There is not an easy way to break that news over LJ to people, but it is a method which I know many of my friends frequent. My suggestion is to get in touch with me over the next month if you want to hang out.

    Tor Relay or Bridge
    For those who have the know how I implore you to set up Tor and either host a Relay or a Bridge for the people in Iran to use so they can get around their governments filters.

    Buffalo Tea Party
    The Tea Party/Tax Revolt will be Sat, March 28, at 2:00 at the Terminus at the
    waterfront.

    It is time for a headcount and so far this looks like it will be big.
    We will get a big crowd there and it will send a message that we are at
    the end of our rope and it is time for citizen action against this unruly
    government, and inform
    Sheldon Silver and Malcom Smith that they do not run this state. We the People
    do; and
    it is time for them to realize this and listen to us.
    All elected officials have been invited by letters and/or emails. So far
    Ghris Lee, Jane Corwin, Dale Volker, Bob Reynolds, John Mills, Sheldon Silver
    have "previous committments".

    Senator Maziarz and Betty Jean Grant will be there. Antoine Thompson said he
    would be there or send a rep.
    I have not yet heard from anyone else.
    The media has also been contacted. Bring signs. Bring a copy of your tax bill.
    If possible, we will burn them
    or just plain tear them up and throw them in the trash. We are also open to
    other
    ideas (within reason, please).

    Court says evidence is valid despite police error

    WASHINGTON – The Supreme Court said Wednesday that evidence obtained after illegal searches or arrests based on simple police mistakes may be used to prosecute criminal defendants.

    The justices split 5-4 along ideological lines to apply new limits to the court's so-called exclusionary rule, which generally requires evidence to be suppressed if it results from a violation of a suspect's Fourth Amendment right to be free from unreasonable searches or seizure.

    The conservative majority acknowledged that the arrest of Bennie Dean Herring of Alabama — based on the mistaken belief that there was a warrant for his arrest — violated his constitutional rights, yet upheld his conviction on federal drug and gun charges.

    Coffee County, Ala., sheriff's deputies found amphetamines in Herring's pockets and an unloaded gun in his truck when they conducted a search following his arrest. It turned out that the warrant from neighboring Dale County had been recalled five months earlier, but the county sheriff's computers had not been updated.

    Chief Justice John Roberts, writing for the court, said the evidence may be used "when police mistakes are the result of negligence such as that described here, rather than systemic error or reckless disregard of constitutional requirements."

    Justices Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas sided with Roberts.

    In a dissent for the other four justices, Justice Ruth Bader Ginsburg said the ruling "leaves Herring, and others like him, with no remedy for violations of their constitutional rights."

    Ginsburg said accurate police record-keeping is of paramount importance, particularly with the widespread use of electronic databases. Justices Stephen Breyer, David Souter and John Paul Stevens also dissented.

    Herring was arrested after a Coffee sheriff's employee asked her counterpart in Dale County whether Herring, called "no stranger to law enforcement" by Roberts, was wanted in Dale. An arrest warrant had been issued in Dale, but it had been recalled by July 2004.

    The sheriff's electronic records, however, showed it was still a valid warrant.

    Acting on that information, Coffee County deputies arrested and searched Herring.

    The Dale employee meanwhile discovered the warrant was no longer valid and called Coffee County to say so. But it was too late for Herring.

    Some courts have ruled that as a deterrent to police misconduct, the fruits of a similar search may be excluded from evidence.

    But the 11th U.S. Circuit Court of Appeals in Atlanta said that suppressing evidence in Herring's case would be unlikely to deter sloppy record keeping.

    The case is Herring v. U.S., 07-513.

    There is one thing everyone should know before becoming involved with government projects. Occasionally you pour your heart and soul into a project only to have it all blow up in your face.

    The trick is to not stop working hard when your back is up against the wall. Work harder. Work until your fucking eyes bleed. If you get laid off you won't feel like you didn't try.

    That being said I still love my job. For all the bullshit, for all the OT, for all the problems.

    Goals to be revisited in One Years Time
    1. Lose 150 lbs. (Weight Watchers)

    2. Keep an eye out for love. You never know when it may sneak up on you.

    3. Not be a hermit anymore. An integral part to 1 is not sitting on my fatass too much. Long walks in the park, on the beach, etc..

    4. Keep working on my degree.

    5. Do the work at work that no one else is willing to because it need to get done.

    6. CLEAN MY APARTMENT.

    I did end the year on a bright note though. Went for Chinese buffet tonight. Our waitress was very nice, but looked like she was having a rough night. It also looked like the other waitress was giving her shit. I gave her a $13 tip. She became all giddy and bouncy and she literally pranced off to gloat. I made someone who I didn't know have a good night in the midst of what appeared to be a bad one for her. I think that just about sets Karma where it needs to be for the New Year. Never has giving someone something like that made me feel so good.
